Washington, D.C. – In response to Senators Peter Welch (D-VT), Marsha Blackburn (R-TN), Adam Schiff (D-CA), and Josh Hawley (R-MO)’s reintroduction of the Transparency and Responsibility for Artificial Intelligence Networks (TRAIN) Act, Re:Create Executive Director Brandon Butler issued the following statement:
“As two federal courts have recently ruled, fair use protects the right to train AI models,” said Re:Create Executive Director Brandon Butler. “The runaway TRAIN Act would nullify the crucial fair use rights of AI researchers, developers, and users, creating a tool for legal harassment that would chill free expression, create overly burdensome requirements for small AI developers, and stifle innovation. While it is important to ensure accountability of emerging technology, TRAIN is not a reasonable transparency regulation for AI; it’s a hunting license for trolls. It offers nothing useful to the public and gives no weight to the interests of any stakeholder other than plaintiffs’ attorneys.”
In support of a balanced copyright framework that benefits creators, rightsholders, and innovation, Re:Create urges policymakers to reject the TRAIN Act and allow the courts to continue developing a balanced framework for copyright and AI.
